These Terms of Use ("Terms") govern your access to and use of the website makemywillonline.com (the "Site") and the online will-generation services and tools provided (collectively, the "Service"). The Service is owned and operated by makemywillonline.com ("MyWill", "we", "us", or "our").

By accessing, browsing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

Your use of the Service is subject to the following critical disclaimers:

  • No Attorney-Client Relationship. MyWill is NOT a law firm. We are not licensed to practice law and do not provide any legal advice. No attorney-client relationship or privilege is created by your use of the Service.
  • Service is for Self-Help Only. The Service is an online tool that provides information and software for individuals to create their own Legal Documents (such as a Last Will and Testament) for self-help. The Service is not a substitute for the advice or services of a qualified attorney.
  • No Legal Review or Recommendation. We do not review any information you provide for legal accuracy, sufficiency, or conclusions. We do not provide legal opinions, recommendations, or strategies. Any information provided by us is for informational purposes only.
  • Laws Vary and Change. The law is a personal matter, and no general information or tool like the one we provide can fit every circumstance. Laws vary by jurisdiction and are subject to change. We do not guarantee that the documents created by the Service will be valid, effective, or suitable for your specific needs in your jurisdiction.
  • You Are Solely Responsible. You are solely responsible for your own estate planning. You are responsible for ensuring your will is properly printed, signed, and witnessed according to the laws of your jurisdiction. 1. Eligibility and Use of the Service

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. You agree to provide true, accurate, and complete information and to use the Service only for its intended purposes—to create estate planning documents for yourself or your partner (with their consent).

2. Fees and Payment

The Service is available for a one-time fee as listed on the Site. You agree to pay all applicable fees. Payments are processed by our third-party payment processor, Stripe. We are not responsible for their service or data practices. All fees are non-refundable unless required by law.

3. Assumption of Risk

You expressly acknowledge and agree that your use of the Service is at your sole risk. You are solely responsible for the content, accuracy, and legal effect of any document you create using the Service. You assume all risks associated with the use of the Service, including the risk that a document created may be incomplete, inaccurate, or legally invalid. You agree that you have been advised to seek independent legal counsel and have chosen not to do so at your own peril.

4. Intellectual Property

The Service and its contents, including all software, text, graphics, and logos, are the exclusive property of MyWill and its licensors, protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service to create, download, and print Legal Documents for your personal, non-commercial use only.

5. **Disclaimer of Warranties**

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, OR STATUTORY.

WE EXPLICITLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE MAKE NO WARRANTY THAT THE SERVICE OR THE DOCUMENTS IT PRODUCES WILL (A) MEET YOUR REQUIREMENTS; (B) BE VALID, ACCURATE, COMPLETE, OR RELIABLE; (C) BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; OR (D) THAT ANY ERRORS WILL BE CORRECTED. YOU USE THE SERVICE AT YOUR OWN DISCRETION AND RISK.

6. **Limitation of Liability and Waiver of Claims**

TO THE FULLEST EXTENT PERMITTED BY LAW, MYWILL (INCLUDING ITS OWNERS, OPERATORS, EMPLOYEES, AND AFFILIATES) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, HOWEVER CAUSED, AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE.

THIS INCLUDES, WITHOUT LIMITATION, ANY DAMAGES, LOSSES, OR LIABILITIES RESULTING FROM:

  • YOUR RELIANCE ON THE SERVICE OR ANY INFORMATION PROVIDED;
  • THE INVALIDITY, INEFFECTIVENESS, OR FAILURE OF ANY LEGAL DOCUMENT CREATED THROUGH THE SERVICE;
  • ANY DISPUTES ARISING FROM YOUR WILL OR ESTATE;
  • ANY INACCURACIES, ERRORS, OR OMISSIONS IN THE SERVICE;
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; OR
  • ANY OTHER MATTER RELATING TO THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THE SERVICE IS LIMITED TO THE GREATER OF (A) THE TOTAL AMOUNT OF FEES YOU PAID TO US FOR THE SERVICE OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

YOU EXPRESSLY AGREE TO WAIVE ANY AND ALL CLAIMS, CAUSES OF ACTION, OR RIGHTS TO SUE MYWILL FOR ANY ISSUES ARISING FROM YOUR USE OF THE SERVICE, WHETHER KNOWN OR UNKNOWN.

7. Indemnification

You agree to defend, indemnify, and hold harmless MyWill, its owners, and its affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising in any way out of or in connection with (a) your use of the Service, (b) your violation of these Terms, (c) any Legal Document you create using the Service, or (d) your negligence or willful misconduct.

8. Governing Law and Dispute Resolution

Any dispute arising from these Terms or the Service shall be resolved exclusively through final and binding arbitration in accordance with the rules of the American Arbitration Association, and not in a court of law.
